Refund Policy

This Refund Policy governs the terms under which refunds may be issued for balance top-ups made for the Tontaube API.
Cremer & Cremer Technologies UG (haftungsbeschränkt) (“we,” “us,” or “Provider”) utilizes Paddle (Paddle.com Market Limited or its affiliates) as our Merchant of Record. This means that when you add balance to your account, Paddle handles the transaction, payment processing, and related tax compliance. By making a purchase, you also agree to Paddle’s Checkout Terms.
1. The “Add Balance” Billing Model
The Tontaube API operates on a prepaid usage model. Users add a prepaid balance in US Dollars (USD) to their account via the Paddle checkout. This balance is then incrementally deducted based on the volume and type of API requests made (e.g., text-to-speech character processing).
2. General Refund Policy
Because the Tontaube API utilizes intensive cloud compute and AI processing resources to generate audio, all balance deductions for successfully processed API requests are final and non-refundable. We do not offer refunds for balance that has already been consumed by the API.
3. Refunds for Unused Balance
Except as required by mandatory consumer protection law (see Section 4) or the terms of our Merchant of Record, purchased prepaid balance is non-refundable.
- No Expiration: Your prepaid balance does not expire as long as your account remains active.
- Account Termination: If you choose to voluntarily close or terminate your account, any remaining unused balance will be forfeited and will not be refunded. We strongly advise users to consume their remaining balance before requesting account deletion.
4. Statutory Right of Withdrawal (EU Consumers Only)
If you are using the API as a Consumer (a natural person acting outside their trade, business, or profession under § 13 BGB) residing in the European Economic Area (EEA), you generally have a statutory right to withdraw from your purchase within 14 days without giving any reason.
Waiver of the Right of Withdrawal:
Due to the digital nature of our services, you expressly consent that we begin the performance of the contract (adding the USD balance to your API account) immediately upon purchase. You acknowledge that by granting this consent and making your first API call (thereby consuming a portion of your balance), you lose your statutory 14-day right of withdrawal.
If you purchase a balance but strictly do not make any API calls within the first 14 days, you may request a full refund of that specific top-up by contacting us.
5. Business / Entrepreneur Users
If you are an Entrepreneur (a natural or legal person acting in the course of their commercial or professional activity under § 14 BGB), the statutory right of withdrawal does not apply. All balance purchases are final.
6. Technical Errors and Disputes
If you believe a technical error occurred on our end—for example, if your balance was deducted but the API failed to return the requested output due to a server-side outage (HTTP 5xx errors)—please contact our support team within 7 days of the incident. We will review server logs and, if the error is verified on our side, we will re-credit the disputed amount back to your Tontaube account balance. We do not issue cash refunds for technical errors.

Please include your account email, developer name, and the Paddle transaction receipt in your request. Depending on the nature of the transaction, we may route your request directly to Paddle support for final processing.
